Personal Use Eviction (Eigenbedarf)

Personal use eviction (Eigenbedarfskündigung): Requirements, notice periods, and rights of tenants and landlords under § 573 BGB.

Legal
§ 573 Abs. 2 Nr. 2 BGB

Also known as: owner-occupancy termination, personal need termination, landlord personal use

Eigenbedarf (personal use) applies when a landlord requires a rented apartment for themselves, family members, or members of their household. The notice period depends on the tenancy duration: 3 months (up to 5 years), 6 months (5-8 years), or 9 months (over 8 years). A fraudulent personal use claim can trigger compensation claims.
